1. Agreement to Terms

Welcome to GoalPair. These Terms of Service ("Terms") govern your access to and use of the GoalPair platform at goalpair.com (the "Service"), operated by GoalPair ("we," "us," or "our").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old to use GoalPair. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. User Types

4.1 Candidates

Candidates are job seekers who can create profiles, share career stories, request referrals, and use the AI Assistant feature. Candidates may also refer other candidates.

4.2 Referrers

Referrers are users who vouch for candidates by writing referrals. Referrals must be genuine and based on actual professional knowledge of the candidate.

4.3 Recruiters

Recruiters are hiring professionals who can discover candidates, view "Open to Work" profiles, and track candidates. Recruiter accounts require verification by GoalPair before full access is granted.

5. Acceptable Use

You agree NOT to:

• Provide false, misleading, or fraudulent information in your profile or referrals
• Create fake accounts, referrals, or career stories
• Impersonate another person or misrepresent your affiliation
• Use the Service for spam, harassment, or abusive behavior
• Scrape, crawl, or collect data from the platform without permission
• Attempt to gain unauthorized access to other accounts or our systems
• Upload malicious code, viruses, or harmful content
• Use the Service for any illegal purpose
• Circumvent or manipulate our security or trust score systems
• Sell, trade, or transfer your account to another party
• Use automated tools to access the Service without our consent

6. Referral System

6.1 Writing Referrals

When you write a referral for another user, you represent that your statements are truthful and based on your genuine professional experience with or knowledge of the candidate.

6.2 Accepting Referrals

Candidates may accept or decline referral requests. Accepted referrals become visible on your profile and to recruiters.

6.3 Trust Scores

GoalPair calculates trust scores based on profile completeness, referral activity, and community engagement. These scores help recruiters identify credible candidates. Manipulation of trust scores is prohibited.

7. Recruiter Reward Program

Recruiters may choose to reward referrers and candidates when a successful hire is made through GoalPair. Participation in the reward program is voluntary.

• Reward amounts are set by recruiters at their discretion
• Rewards are processed through Stripe and subject to payment processing fees
• GoalPair is not responsible for disputes between recruiters and reward recipients
• Recipients are responsible for any applicable taxes on rewards received

8. AI Assistant (GoalPair AI)

8.1 Credits

The AI Assistant feature requires credits. New users receive free credits upon registration. Additional credits can be purchased. Credits are non-refundable and non-transferable.

8.2 AI Limitations

The AI Assistant provides career guidance based on community content and AI-generated insights. You acknowledge that:

• AI responses are for informational purposes only and not professional advice
• You should not rely solely on AI responses for career decisions
• AI-generated content may contain inaccuracies or errors
• GoalPair is not liable for decisions made based on AI responses

9. Payments and Billing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are displayed in USD. All credit purchases are final and non-refundable, except as required by law.

10. Content and Intellectual Property

10.1 Your Content

You retain ownership of content you create (profile information, career stories, referrals). By posting content, you grant GoalPair a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

10.2 Our Content

GoalPair and its logos, designs, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10.3 Content Moderation

We reserve the right to remove any content that violates these Terms, is fraudulent, offensive, or otherwise inappropriate, without prior notice.

11. Open to Work Feature

When you enable "Open to Work," your profile and resume become visible to verified recruiters. You can disable this feature at any time. GoalPair does not guarantee job placements or recruiter outreach.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• The accuracy or reliability of any referrals, profiles, or content
• That you will receive referrals, job offers, or hire candidates
• Uninterrupted or error-free access to the Service
• The accuracy of AI-generated responses

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOALPAIR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless GoalPair and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

16. Termination

You may delete your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
